| Warranties.
Summerland warrants to Buyer that all goods furnished are of good quality
and new, and free of manufacturing defects. Summerland warranties all
goods to be free from labor and material defects for a period of one year
after installation unless abused, neglected, or improperly used or installed,
and Summerland shall repair or replace, at its option and at no cost to
Buyer, any goods that exhibit or material defects within the warranty
period that are not attributable to neglect, abuse, or improper use or
installation of the goods. Summerland cannot and does not warrant that
all goods will conform to state and local codes and regulations in the
state of final destination. Summerland hs no control over end products
fabricated with the materials sold or the installation procedures used.
The customer shall test and verify the suitability of the product for
intended use. All material must be inspected for quality before installation,
and load tested to confirm proper installation and operation after installation.
Customer assumes all risks and liability. Summerland shall not be liable
for any damages, including, but not limited to, physical injury or lost
profits. In order to assert rights under this warranty, Buyer must notify
Summerland, in writing, of the defective goods and the nature of any defect
within three weeks of discovery of the defect. Summerland's liability
is limited to the cost of the defective product. Returned Goods: All sales are final. Custom manufactured products are not returnable. Stock items ordered in error may be returned for credit less a 20% restocking charge, within 30 days. Returns must be sent freight prepaid & insured, unused, undamaged, and in original packing materials. Returns over 30 days from date of purchase will not be accepted. Returns will be at Summerland's discretion, custom engineering charges may apply. Please do not return any merchandise for any reason without first calling our Customer Service Dept. at 772-219-0455 for authorization. Unauthorized returns will be refused at our facility. |
